Questverse – Terms of Use

1. Agreement to Terms

By downloading, installing, or using any application published by Questverse AS ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms apply to all applications and services published by Questverse AS, including but not limited to StudyBlast. These Terms constitute a legally binding agreement between you and Questverse AS, a company registered in Norway ("Questverse", "we", "us", "our").

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.


3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.


4. License

The App is licensed, not sold, to you. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. You may not rent, lease, lend, sell, transfer, redistribute, or sublicense the App. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof, except as and only to the extent permitted by applicable law. Any attempt to do so is a violation of the rights of Questverse and its licensors.


5. Subscriptions

The App offers auto-renewable subscription plans ("Basic+" and "Premium") that provide access to enhanced features including ad-free experience, monthly crystal allowances, and AI-powered study tools.

  • Payment is charged to your Apple ID account at confirmation of purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan (monthly, 3-month, or yearly).

  • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.

  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

  • Prices are displayed in your local currency and may vary by region. All prices include applicable taxes where required.


6. In-App Purchases

The App offers consumable in-app purchases ("Crystal Packs") that provide in-app virtual currency ("Crystals"). Crystals are used within the App to access content generation features. Crystals have no real-world monetary value and cannot be exchanged, transferred, or refunded except as required by applicable law.


7. User-Submitted Content

7.1. Your Responsibility. You may submit text, images, photographs, PDF documents, and other materials ("Source Material") to the App for the purpose of generating educational content. You represent and warrant that:

  • You have the legal right to use and submit the Source Material for personal educational purposes.

  • Your submission of Source Material does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

  • You will not submit Source Material that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable.

  • You are solely responsible for ensuring your use of Source Material complies with all applicable copyright laws, including fair use/fair dealing provisions in your jurisdiction.

7.2. Indemnification for Source Material. You agree to indemnify, defend, and hold harmless Questverse AS, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your submission of Source Material that infringes or is alleged to infringe the intellectual property or other rights of any third party; (b) your breach of any representation or warranty in these Terms; or (c) your violation of any applicable law.

7.3. Our Right to Remove. We reserve the right to remove, disable, or restrict access to any Source Material or content generated therefrom at any time, without notice, if we reasonably believe it infringes third-party rights or violates these Terms.

8. AI-Generated Content and Intellectual Property

8.1. AI-Generated Educational Content. The App uses artificial intelligence to process your Source Material and generate derivative educational content, including but not limited to questions, answers, flashcards, formatted study notes, and topic summaries ("Generated Content").

8.2. Licence Grant to Questverse. By using the App to generate content, you grant Questverse AS a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit the Generated Content (including questions, flashcards, formatted text, and topic structures) for any purpose, including but not limited to:

  • Improving and training AI models and algorithms

  • Creating, curating, and selling educational content, courses, and modules

  • Enhancing the App and related services

  • Research and development of educational technology

  • Marketing and promotional purposes

8.3. Source Material Distinction. This licence applies to the Generated Content (AI-produced questions, flashcards, study materials, and topic structures), not to the underlying Source Material you submitted. We do not claim ownership of your original Source Material. However, you acknowledge that Generated Content, while derived from your Source Material, constitutes independently created works produced by our AI systems.

8.4. No Guarantee of Accuracy. Generated Content is provided for educational purposes only and may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any Generated Content. You should not rely on it as a sole source of information for academic, professional, or other consequential decisions.

8.5. Platform Content. All content, features, and functionality of the App — including but not limited to software, design, text, graphics, logos, icons, and educational content created by Questverse — are owned by Questverse AS and are protected by international copyright, trademark, and other intellectual property laws.

9. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.

  • Attempt to gain unauthorised access to any part of the App, its servers, or any connected systems.

  • Interfere with or disrupt the integrity or performance of the App.

  • Reverse engineer, decompile, or disassemble any part of the App.

  • Use automated means to access or interact with the App.

  • Exploit bugs or vulnerabilities to gain unfair advantages, including but not limited to manipulating virtual currency balances.

  • Upload, submit, or distribute content that is harmful, offensive, defamatory, or infringes on the rights of others.

  • Systematically download, scrape, or extract content from the App for commercial purposes.

  • Use the App to create competing products or services.

10. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that any content available through the App infringes your copyright, please contact us at hello@questverse.io with the following information:

  • A description of the copyrighted work you claim has been infringed.

  • A description of where the allegedly infringing material is located in the App.

  • Your contact information.

  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner.

  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

We will respond to valid notices and take appropriate action, which may include removing or disabling access to the content in question.

11. External Services and Third-Party Materials

The App may enable access to third-party services and content ("External Services"), including Apple StoreKit, Google Firebase, Google AdMob, Supabase, and AI service providers. Use of External Services may require Internet access and acceptance of additional terms.

You acknowledge that we are not responsible for examining or evaluating the content, accuracy, or reliability of any third-party services or materials. We do not warrant or endorse any third-party services and shall not have any liability for them. Third-party services are provided solely as a convenience.

12. Consent to Use of Data

You agree that we may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the App. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you. 13. Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App or any part of its features at any time, with or without notice. We will make reasonable efforts to notify active subscribers of material changes that affect their subscription benefits. We are not liable to you or any third party for any modification, suspension, or discontinuance.

14. Disclaimer of Warranties

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ANY SERVICES PERFORMED OR PROVIDED BY THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. QUESTVERSE HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

QUESTVERSE DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED BY THE APP WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS IN THE APP WILL BE CORRECTED.

SOME JURISDICTIONS, INCLUDING NORWAY AND THE EU/EEA, DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS AND LIMITATIONS SHALL APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

15. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL QUESTVERSE BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF QUESTVERSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL QUESTVERSE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO QUESTVERSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY US DOLLARS ($50.00).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER NORWEGIAN CONSUMER PROTECTION LEGISLATION (FORBRUKERKJØPSLOVEN), EU CONSUMER RIGHTS DIRECTIVES, OR FOR FRAUD OR WILFUL MISCONDUCT.

16. Termination

We may suspend or terminate your access to the App at our discretion if you violate these Terms. The licence is effective until terminated by you or Questverse. Your rights under this licence will terminate automatically without notice if you fail to comply with any term(s) of these Terms. Upon termination, you shall cease all use of the App. Sections 7, 8, 14, 15, and 17 survive termination.

17. Governing Law and Disputes

These Terms are governed by the laws of Norway. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Norway, unless mandatory consumer protection laws in your jurisdiction provide otherwise. If you are a consumer within the EU/EEA, you retain the right to bring proceedings in the courts of your country of residence.

18. Export Compliance

You may not use or otherwise export or re-export the App except as authorised by applicable law and the laws of the jurisdiction in which the App was obtained.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
